Effective Date: July 22, 2020   This document sets forth the terms and conditions that apply to any purchases made on the marybarbera.com website (the “Site”) or any other sites owned by Barbera Behavior Consulting, LLC (the “Company,” “We,” or “Us”).   These Terms are in addition to the general Terms of Service and Privacy Policy, each of which are incorporated herein by this reference. PLEASE REVIEW THIS DOCUMENT IN ITS ENTIRETY BEFORE ENTERING INTO ANY TRANSACTION TO CONFIRM YOUR ACCEPTANCE HEREOF. YOU MAY NOT ORDER OR OBTAIN PRODUCTS OR SERVICES FROM THIS SITE UNLESS AND UNTIL YOU: (A) AGREE TO THESE TERMS AND CONDITIONS IN THEIR ENTIRETY; (B) ARE AT LEAST 18 YEARS OLD; AND (C) ARE NOT PROHIBITED FROM ACCESSING OR USING THIS SITE OR ANY OF ITS CONTENTS, GOODS, OR SERVICES BY ANY APPLICABLE LAW, RULE, OR REGULATION. 1. Applicability. These Terms of Purchase (these “Terms“) shall apply to your purchase of products and related services through the Site. These Terms are subject to change at any time without prior written notice by us. The most recent version of these Terms shall be posted for your review at any time on the Site. Please review these Terms in their entirety prior to engaging in any transaction on the Site. Your continued use of the Site after any posting of updated Terms (which shall be dated as of their most recent update) shall constitute your acceptance of and agreement to any changes therein made. 2. Products. The items available for purchase on the Site include online courses and membership, each of which are described below. (a)  Courses: Online courses include: (i) access to in-depth video modules, tools, downloads, and homework to correspond to each lesson; (ii) monthly live Q and A sessions; and (iii) access to the private Facebook group associated with the course (collectively, “Course Content”).  Purchase of a Course includes access to all Course Content for a set period of time as described on the Site (i.e., 60 days), commencing on the date of purchase. (b)  Membership:  Upon completing a course, participants are offered a paid monthly membership option, which provides: (i) continued access to all Course Content; (ii) access to additional video lessons covering various topics; and (iii) discounts on additional courses. 3. General Terms. When placing an order for a Course of Membership, you are effectively offering to purchase whatever products and services you select. We reserve the right to accept or reject any order in our own discretion. We will only accept or reject an order in its entirety. Should we elect to accept your offer, you will receive a confirming email at the email address that you provide at such time. Notwithstanding, we reserve the right to cancel any order once accepted by us (as evidenced by a confirming email) at any time in our sole discretion. Additionally, you have the option of cancelling your order as described in Section 5. (a)  License Agreement.  For each Course purchased, subject to the limitations set forth herein, you are granted a revocable, non-exclusive, non-transferable, limited right and license to access all Course Content for your personal use, and a limited license to share and display up to five (5) lessons within the Course, provided that you are personally present when displaying such lessons.  You may not share your login information with anyone, nor permit third parties to log in using your access credentials.  The term of your License shall commence on the date of your initial purchase and will end when the Course access period terminates, unless extended by monthly membership, in which case the License shall continue for so long as your membership remains in effect.  We reserve the right to immediately terminate your license if you use the Course in a manner contrary to the terms set forth in this Section or in breach of any other of these Terms of the Terms of Service.  The Company retains all right, title and interest in and to the Course Content, including, but not limited to, all copyrights, trademarks, trade secrets, trade names, proprietary rights, patents, titles, computer codes, and all other rights whether registered or not and all applications thereof 4. Payment Terms. (a)  For Courses: All applicable prices for Courses are as set forth on the Site.  Your access to the Course materials will commence on the date of your initial transaction and will continue for the period specified in the Course description.  Unless you purchase a monthly membership, your access to Course materials will cease at the conclusion of the access period. Payment may only be made with a valid credit, debit card, or use of a bona-fide electronic payment provider (i.e., PayPal).  By using any such card or payment provider, you are hereby representing and warranting your full right and authority to make such purchase in the manner elected without violating any applicable law, rule, or regulation. (i)   Promotional Pricing:  Prices for Courses listed on the Site may differ from the prices offered elsewhere (online or offline) by us for the same Courses. Such prices are subject to change at any time by us in our sole discretion.  Additionally, to the extent that we offer a promotion in connection with any particular Course, the terms of such offer shall be set forth in a separate document that shall govern its applicability (and, in the event of a conflict herewith, be considered the governing document). You will be responsible for the prices stated at the time of your purchase. (b)  For Membership:  Membership fees are billed on a monthly or annual basis as described on the Site.  If you select monthly billing, your credit card will be charged on the date of your initial purchase and every 30 days thereafter until you cancel.  For annual payments, your card will be charged on the date of your initial purchase and again on each anniversary of your initial purchase. (i)   RECURRING BILLING DISCLOSURE:  For monthly or annual payments, you understand and agree that your card will be charged in the manner described above on a regular, recurring basis until you cancel. 5. Cancellations and Refunds. (a)  For Courses:  If you are not satisfied with the content of the course Autism ABA Help, you may request a refund of the purchase price paid by sending an email to [email protected] or completing this form within 14 days of the date of your initial purchase.  Refund requests submitted after 14 days of purchase are invalid and will not be honored. Partial refunds are not offered. (b)  For Membership:  No refunds are available for paid membership fees. However, you can cancel your membership at any time by completing this form or by emailing a cancellation request to [email protected] Cancellation requests must be received at least 5 days prior to your next bill date to avoid future charges.  Once your cancellation is submitted, you will retain access until the end of your current billing month. 6. Privacy Policy and Terms of Service: Our Site Privacy Policy governs our processing of all personal information that we may collect from any person through the use of our Site. The Website Terms of Service governs your use of our Site in general, and also include important warranty disclaimers and limitations of liability which also apply to these Terms.
